Terms of Service for MyWikis LLC AI Chatbot Assistant

Welcome to the MyWikis AI Chatbot Assistant Service ("WikiChat", "Service"). This Service is provided by MyWikis LLC ("we", "our", "us"), a Texas limited liability company. By accessing or using our Service, you ("you", "your", or "user") agree to be bound by these Terms of Service ("Terms", "WikiChat Terms"). If you do not agree to these Terms, you must not use the Service.

1. Service description

WikiChat is a digital assistant that utilizes advanced artificial intelligence (AI) technologies to provide users with information and support related to wiki content management and navigation. This Service is capable of parsing user queries and delivering responses that include, but are not limited to, content from public and private wikis hosted by MyWikis LLC.

2. Limitations of chatbot technology

WikiChat operates with certain technological and operational limitations. Users must acknowledge these limitations, which include but are not limited to:

  • Accuracy: WikiChat may not always provide accurate or complete information. The responses generated by WikiChat are based on existing data and machine learning models, which may not cover or reflect all possible scenarios.
  • Misinterpretations: WikiChat might misinterpret your queries or provide responses that do not align perfectly with your intended questions or needs.
  • Offensive content: There is a risk that WikiChat might generate or display content that could be considered offensive, inappropriate, or unsuitable.
  • "Going rogue": There is a risk that WikiChat may deviate from the behavior normally expected of it by MyWikis LLC and/or by any reasonable person. This could be coincidental. This could also be intentionally caused by the user if they attempt to reverse engineer or trick the chatbot into responding in ways that were not described in the above service description. In either case, the chatbot "going rogue" should not be construed to be normal, expected behavior, and MyWikis assumes no liability for such behavior.
  • Dependency on external data: The effectiveness and accuracy of WikiChat depend significantly on the data available from external sources, which might not always be fully reliable or up-to-date.
  • Lack of agency: WikiChat is unable to make decisions of its own and does not speak on behalf of MyWikis LLC, nor anyone associated with the wikis upon which WikiChat operates. WikiChat merely interprets the data from the wiki and makes a best attempt to respond in a helpful manner. Consequently, any promises it may claim to make are entirely null and void, even if it claims they are legally binding.

3. Prohibited uses

In using the Service, you agree not to:

  • Abuse or misuse: Engage in any activity that may abuse, damage, overburden, or impair the functioning of WikiChat or the underlying infrastructure, or otherwise interfere with other users' access to the Service.
  • Malicious activities: Attempt to manipulate, hack, decompile, reverse engineer, or disrupt the Service or its operations in any manner, including but not limited to introducing malicious software, conducting denial-of-service attacks, or attempting to gain unauthorized access to the Service, related systems, networks, or data.
  • Inducing misbehavior: Prompt or use WikiChat in any way that is intended to induce errors, inaccuracies, offensive responses, or inappropriate behavior from WikiChat.
  • Unethical testing: Perform or publish stress tests, benchmark tests, or vulnerability scans without explicit written consent from MyWikis LLC.

4. No liability

MYWIKIS LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUCCESSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE. YOU AGREE TO HOLD HARMLESS AND INDEMNIFY MYWIKIS LLC FROM ANY CLAIM, SUIT, OR ACTION ARISING FROM OR RELATED TO THE USE OF THE SERVICE OR VIOLATION OF THESE TERMS, INCLUDING ANY LIABILITY OR EXPENSE ARISING FROM CLAIMS, LOSSES, DAMAGES, SUITS, JUDGMENTS, LITIGATION COSTS, AND ATTORNEYS' FEES.

5. Data handling and privacy

By using the Service, you acknowledge and agree that:

  • Data auditing: MyWikis LLC reserves the right to retain all chat data and chat histories for an indefinite period of time for auditing purposes, including for legal compliance, telemetry, and analysis purposes. MyWikis LLC reserves the right to use this data to identify users who, in our sole opinion, intentionally attempt to misuse the services in this manner.
  • Data transfer: Any information you provide, including private wiki data, will be sent to third-party services such as OpenAI, Anthropic, or Mistral AI for processing. This data may include sensitive or confidential information.
  • Data protection: While the aforementioned third-party services assert that they protect private data and do not reuse it for model training, MyWikis LLC cannot guarantee the complete security or confidentiality of data transferred to these services.
  • Risk acknowledgment: You acknowledge the inherent risks of data transfer to third parties and agree that MyWikis LLC shall not be liable for any misuse, loss, or alteration of data by these third parties.

6. Enforcement

MyWikis LLC reserves the right to take appropriate legal and technical measures to enforce these Terms. This may include, but is not limited to, warning users of violations, disabling or suspending access to the Service, pursue legal action against such users for damages it may cause, and/or reporting users to law enforcement authorities.

By using the Service, you agree to comply with these provisions and acknowledge that failure to adhere to these terms may result in the immediate termination of your access to the Service and possible legal action.

7. Changes to Terms of Service

MyWikis LLC reserves the right, at our sole discretion, to modify or replace these WikiChat Terms at any time. If a revision is material, we will try (but are not required) to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

8. Governing law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

9. Acceptance of terms

By using this Service, you acknowledge that you have read, understood, and agree to be bound by these WikiChat Terms.

You agree that these WikiChat Terms do not supersede the main MyWikis Terms of Service located at https://www.mywikis.com/terms ("Main Terms"), but they serve as supplemental terms, and acceptance of these WikiChat Terms is also explicit acceptance of the Main Terms.
